Terms of Use

1. Purpose and acceptance

These Terms of Use (the "Terms") govern access to and use of the Etsnipe service, available at https://etsnipe.app and its associated browser extension. They form a binding agreement between the user and the publisher of the service.

By accessing the service, creating an account or installing the browser extension, the user acknowledges having read, understood and accepted these Terms without reservation. If you do not accept these Terms, you must stop using the service immediately and uninstall the extension.

These Terms must be read alongside the Terms of Sale and the Privacy Policy, which form an indivisible whole.

2. Definitions

• Service: the Etsnipe web application, its API and its browser extension.
• User: any natural or legal person who creates an account on the service.
• Credits: usage units allowing access to AI generation features.
• Subscription: recurring paid plan giving access to the service and a periodic credit allowance.
• Generated content: any text, image or other output produced by the artificial intelligence models used by the service.

3. Description of the service

Etsnipe is a SaaS (Software as a Service) tool aimed at e-commerce sellers, in particular Etsy sellers. The service allows the user to:

• Extract publicly available product data via a dedicated browser extension
• Automatically generate optimized Etsy listings (title, description, tags, price) using artificial intelligence
• Generate product and lifestyle visuals using artificial intelligence
• Save, manage and export listings in formats compatible with Etsy
• Track shop performance and accounting indicators

Etsnipe is an independent service. It is not affiliated with, sponsored by or endorsed by Etsy Inc., AliExpress, Alibaba Group or any other third-party platform mentioned in the service. Trademarks cited belong to their respective owners.

4. Access and user account

Access to the service requires the creation of a personal account with a valid email address. Account creation is free; access to paid features requires an active subscription.

4.1 Minimum age

The service is reserved for persons aged 16 or over. By creating an account, the user certifies being at least 16 years old. Accounts identified as being held by minors under 16 will be deleted without notice.

4.2 Account security

The user is solely responsible for the confidentiality of their login credentials. Any action carried out from the account is presumed to have been carried out by its holder. The user must immediately notify the publisher of any suspected fraudulent use of their account.

Sharing a single account between several people, the creation of multiple accounts by the same person to circumvent free quotas, and the resale or assignment of an account to a third party are strictly prohibited.

5. Credit system and subscription

Access to AI generation features requires an active subscription and a sufficient credit balance.

• Listing generation (title, description, tags, price): 1 credit per product
• Image generation: 1 credit per image

Credits granted by a subscription are valid only during the current billing cycle and as long as the subscription remains active. At each renewal, the credit balance is reset to the subscribed plan's quota: unused credits do not accumulate and do not roll over to the next cycle. Credits purchased separately in addition to a subscription remain available as long as the user holds an active subscription. In the event of subscription termination, unused credits expire without entitlement to a refund, except in the event of a proven malfunction of the service attributable to the publisher.

Credits are strictly personal, non-transferable, non-resellable and have no monetary value outside the service.

Detailed payment terms (subscription, automatic renewal, withdrawal) are governed by the Terms of Sale.

6. Prohibited uses

The user agrees not to use the service for any unlawful or harmful purpose, and in particular not to:

• Reverse engineer, decompile or attempt to extract the source code of the service
• Use automated scripts, bots or any technical means to artificially exceed quota limits
• Resell, sublicense or republish the service or its outputs as a service in their own right
• Generate content that is illegal, infringing, defamatory, discriminatory, pornographic, violent or related to minors
• Use the service to generate content infringing the trademarks, copyright or image rights of third parties
• Use the service to mass-publish listings violating the policies of marketplaces (Etsy, Amazon, eBay, etc.)
• Carry out activities undermining the security, integrity or availability of the service (denial of service, intrusion, etc.)
• Create multiple accounts to circumvent quota or pricing restrictions

Any breach of these prohibitions may result in immediate suspension or termination of the account, without entitlement to a refund and without prejudice to legal proceedings.

7. Artificial intelligence and generated content

The service uses artificial intelligence models provided by third-party providers to generate text and images. The user is informed and accepts that:

• Generated content is produced by probabilistic algorithms and may contain inaccuracies, omissions or errors.
• Two generations from the same input may produce different results.
• The publisher does not guarantee that generated content complies with the policies of marketplaces (Etsy in particular), nor with applicable trademark, copyright or competition laws in the user's country.
• It is the user's sole responsibility, as the seller, to review, correct and validate generated content before any commercial use or online publication.
• Generated content may, depending on the jurisdiction, not be protected by copyright, given its automated nature.

The user retains ownership of the input data they supply and of the generated outputs, subject to the rights of the original AI providers as set out in their own terms. The publisher claims no ownership over the listings generated for the user.

The publisher reserves the right to filter or block generation requests that violate the prohibitions set out in article 6.

8. Browser extension and data collection

The service offers a browser extension that allows the user to extract publicly visible product data from third-party sites. The user is informed that:

• The use of this extension on third-party sites is governed by the terms of use of those sites, and the user is responsible for compliance with them.
• The extension only extracts data publicly accessible on the pages visited by the user. It does not access protected accounts or restricted data.
• The publisher cannot be held liable for any consequences of the use of the extension on third-party sites, including any restriction or sanction taken by those sites against the user.

The user uses the extension at their own risk and undertakes to use it in accordance with the laws of their country.

9. Intellectual property

All elements making up the service (source code, interface, design, brand, logo, content of the site) are the exclusive property of the publisher and protected by French and European intellectual property laws. Any reproduction, modification, distribution or exploitation without prior written authorization is strictly prohibited.

The non-exclusive, non-transferable and revocable licence granted to the user under these Terms is limited to personal or professional use of the service in accordance with these Terms.

10. Limitation of liability

The service is provided "as is" and "as available". The publisher uses all reasonable efforts to ensure the proper operation of the service but provides no guarantee of:

• Permanent availability of the service (the user accepts that interruptions, maintenance and technical incidents may occur)
• Accuracy, completeness or relevance of content generated by AI
• Compliance of generated content with Etsy policies, the laws of the user's country or the rights of third parties
• Specific commercial results from using the service (sales, ranking, visibility, etc.)

In particular, the publisher cannot be held liable for any suspension, restriction, banning or sanction taken by Etsy, AliExpress or any third-party platform against the user as a result of the use of generated content or the extension.

To the maximum extent permitted by applicable law, the publisher's overall liability is limited to the amount paid by the user during the twelve (12) months preceding the event giving rise to liability. The publisher cannot be held liable for indirect damage, loss of business, loss of revenue, damage to image or loss of data.

11. Evolving service

The service is constantly evolving. The publisher reserves the right to add, modify, restrict or remove features at any time, in particular to integrate new AI providers, improve performance or comply with new legal obligations. Such changes may be made without prior notice provided they do not significantly alter the core of the service paid for by the user.

Certain features may be marked as "beta" or "experimental". They are provided as is and may be unstable, modified or removed at any time.

12. Force majeure

Neither party shall be held liable for the non-performance or delay in performance of its obligations resulting from force majeure within the meaning of article 1218 of the French Civil Code, including without limitation: pandemic, natural disaster, government act, war, cyberattack, failure of essential third-party services (electricity, internet, payment, AI providers, cloud hosting).

13. Suspension and termination

The publisher reserves the right to suspend or terminate, immediately and without notice, any account that:

• Violates these Terms or the Terms of Sale
• Is the subject of unpaid amounts (after notice without effect)
• Engages in fraudulent or abusive use of the service
• Generates illegal content or content infringing the rights of third parties

The user may terminate their account at any time from the settings of their account or by contacting support. Termination by the user results in the loss of access to the service and unused credits, without entitlement to a refund of sums already paid (subject to the Terms of Sale).

14. Amendment of the terms

The publisher reserves the right to amend these Terms at any time. In the event of a significant change, the user will be informed by email and by in-app notification at least fifteen (15) days before entry into force. The user may then either accept the new Terms by continuing to use the service, or terminate their account before entry into force.

15. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution as a priority by contacting support.

In the absence of agreement, and unless otherwise provided by public policy (in particular consumer law), the competent courts within the jurisdiction of Paris shall have exclusive jurisdiction.
